Hulk Hogan, Gawker back in court in Florida

A court hearing involving the Hulk Hogan sex tape case is underway in Florida, with Gawker Media asking for a new trial.
Gawker and Hogan faced off Wednesday morning in a St. Petersburg courtroom. It's the latest chapter in a years-long legal fight.
Hogan, whose real name is Terry Bollea, won a $140 million verdict against Gawker in March.
Hogan sued Gawker after it posted a video of him having sex with his then-best friend's wife. The three-week trial was a lurid inside look at the business of celebrity gossip and a debate over newsworthiness versus celebrity privacy.
Earlier this month, Hogan sued Gawker again, saying the gossip website leaked sealed court documents with a transcript that quoted him making racist remarks.

Breyer says Supreme Court not diminished with only 8 members

Justice Stephen Breyer said Monday that the Supreme Court has not been diminished by having only eight members since the death of Justice Antonin Scalia in February.
Breyer suggested in response to questions at an awards ceremony at the Library of Congress that Scalia would have made a difference in only four or five cases out of more than 70 the court will decide this term.
"We may divide 4-4 in four or five cases, we may not," Breyer said of the term than will end in June.
That could include some of the term's biggest cases involving abortion and immigration. A tie vote would leave the lower court ruling in place and prevent the court from setting a legal precedent that applies to the entire country.
The court has already deadlocked in three cases, including a high-profile dispute over public-sector labor unions. And last week, the justices returned a dispute over access to birth control to lower courts, suggesting they could not form a majority that would have settled a major conflict over the scope of the nation's health care law.
Breyer stressed that the court in recent years has ruled unanimously about half the time and divided 5-4 in only a small percentage of cases. Chief Justice John Roberts and Justices Samuel Alito and Elena Kagan also have said in recent public comments that the court would find its way until a ninth justice is confirmed.
Breyer did not address the partisan debate over whether the Senate should confirm Judge Merrick Garland, nominated by Obama to take Scalia's seat. Senate Republicans have refused to hold a hearing on Garland's confirmation or schedule a vote, saying the choice should be left to Obama's successor.

Appeals court rules Mississippi can resume Google inquiry

Mississippi's attorney general can resume an investigation into whether Google facilitates illegal behavior, an appeals court ruled.
The 5th U.S. Circuit Court of Appeals on Friday overturned a district judge who had sided with Google. U.S. District Judge Henry T. Wingate ruled last year that the unit of Alphabet Inc. didn't have to answer a subpoena by Mississippi Attorney General Jim Hood.
Hood began complaining in 2012 that Google wasn't doing enough to prevent people from breaking the law. In October 2014, he sent a 79-page subpoena demanding Google produce information about a wide range of subjects, including whether Google helps criminals by allowing its search engine to lead to pirated music, having its autocomplete function suggest illegal activities and sharing YouTube ad revenue with the makers of videos promoting illegal drug sales. Instead of complying, Google sued.
The appeals court also dissolved the lower judge's injunction that had barred Hood from bringing any civil or criminal lawsuits against the Mountain View, California-based company, saying that a mere subpoena wasn't enough to rule that Hood was acting in bad faith.

Court cuts prison sentence for Memphis 'sovereign citizen'

An appeals court has reduced the prison sentence for a self-described sovereign citizen who was convicted of assaulting two police officers during a traffic stop.
Tabitha Gentry was convicted in April 2014 of two counts of aggravated assault and one count of evading arrest in an automobile.
The judge sentenced Gentry to consecutive prison sentences of six years on each assault charge and two years on the evading arrest charge, totaling 14 years.
Tennessee's Court of Criminal Appeals ruled Monday that the judge should have ordered that the sentences run at the same time, reducing her sentence in that case to six years.
Gentry also is serving a 20-year sentence for illegally taking over a Memphis mansion. The appeals court ruling cuts her total prison time from 34 years to 26 years.

Philippine court enters not guilty plea for US Marine

A Philippine court entered a not guilty plea Monday for a U.S. Marine charged with murdering a transgender Filipino, allegedly after he discovered her gender when they checked into a hotel.
Marine Pfc. Joseph Scott Pemberton refused to enter a plea in the brief proceeding in a court in Olongapo city northwest of Manila, according to Justice Secretary Leila de Lima. Journalists were barred from the courtroom.
Dozens of left-wing protesters waved red flags outside the courthouse, demanding justice and an end to the U.S. military presence in the former American colony. Gay and lesbian groups have also staged protests denouncing the killing of Jennifer Laude, whose former name was Jeffrey, as a hate crime.
Monday's arraignment paves the way for Pemberton's trial, which lawyers of the victim's family said is scheduled to start next month.
"Finally justice can be attained for our sibling," Marilou Laude, the victim's sister, told reporters. She said she was shaking in anger when she saw the handcuffed suspect, who was guarded by several security escorts in the courtroom.
Pemberton has been charged by prosecutors in the Oct. 11 killing. They say the U.S. Marine strangled her and then drowned her in a hotel toilet after discovering she was a transgender woman. They had checked into the hotel after meeting in a bar.
